Terms of Service — Nova Dominion

These Terms of Service ("Terms") govern your use of the online strategy game Nova Dominion and its related website, services and applications (together, the "Service"). The Service is operated by Gold Development, having its registered office at Coolsingel 139, 3012 AG Rotterdam, registered with the Netherlands Chamber of Commerce (KvK) under number 61213535, VAT number NL002254942B32 ("we", "us", "the operator"). Please read these Terms carefully. By creating an account or using the Service, you agree to these Terms.

1. Acceptance of the terms

1.1 By accessing the Service, registering an account or playing the game, you confirm that you have read, understood and accepted these Terms, as well as our Privacy Policy, our Cookie Policy and, if you take out a paid subscription, our Refund & Subscription Terms.

1.2 If you do not agree to these Terms, you must not use the Service.

1.3 Nova Dominion is a free-to-play game. No purchase is required to play.

2. Eligibility and age

2.1 You must be at least 16 years old to create an account and use the Service. In the Netherlands, consent to the processing of children's personal data in connection with information-society services is subject to an age limit of 16 years (GDPR).

2.2 If you are under the required age, you may use the Service only with the consent and under the supervision of a parent or legal guardian, to the extent permitted by applicable law.

2.3 By using the Service, you represent that you meet these age requirements and that the information you provide is accurate.

3. Account and security

3.1 Playing requires an account consisting of an email address, a username and a password. Your password is stored only in encrypted (hashed) form; we never store your password in plaintext.

3.2 You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Do not share your password with anyone.

3.3 You must notify us without delay at info@gold-development.nl if you suspect any unauthorised use of your account or any security breach.

3.4 One person may hold the number of accounts permitted by the game rules. Abusing multiple accounts ("multi-accounting") to gain an unfair advantage is prohibited (see section 5).

4. Processing of personal data

4.1 When you use the Service we process personal data, including your email address, username, hashed password, language preference and gameplay data. How we do this and on what legal bases is described in our Privacy Policy.

5. Acceptable use, fair play and cheating

5.1 You agree to use the Service only for lawful purposes and in accordance with these Terms and the in-game rules.

5.2 You must not:

• (a) use the Service in any way that breaches applicable laws or regulations;
• (b) use bots, scripts, automated clients, macros or other tools that circumvent the normal operation of the game or provide an unfair advantage;
• (c) exploit vulnerabilities, bugs or errors instead of reporting them to us;
• (d) share, sell, trade or transfer accounts, or trade virtual items outside the Service for real money;
• (e) harass, threaten, deceive, dox or impersonate other players;
• (f) post or distribute unlawful, abusive, hateful, obscene or otherwise inappropriate content;
• (g) disrupt, overload or gain unauthorised access to the Service, its servers or networks (for example through hacking or denial-of-service).

5.3 Fair play. Nova Dominion is a competitive, shared, persistent game. We take fairness seriously. Breaches of this section may result in warnings, rollback of game progress, temporary suspension or permanent deletion of the account (see section 11), at our reasonable discretion.

6. Virtual items and the Commander Pass

6.1 The Service may offer virtual items, currency, benefits and an optional paid subscription (the "Commander Pass").

6.2 No "pay-to-win". Paid benefits provide convenience and cosmetic features only. They never increase your in-game power, production or combat outcomes, and give you no advantage over other players that a dedicated free player cannot also reach through time and effort.

6.3 No real-money value. Virtual items and subscription benefits have no real-money value, are not owned by you and cannot be exchanged for money, except to the extent required by mandatory law. You obtain a limited, personal, non-transferable, revocable licence to use them within the Service.

6.4 We may modify, manage or discontinue virtual items and benefits at our reasonable discretion. If the Service is discontinued, virtual items lapse without any right to compensation, save as required by mandatory law.

7. Payments

7.1 The Commander Pass is an optional paid subscription with various durations (day, week, month, year). Payments are processed by our payment provider Mollie; we do not ourselves store any card data.

7.2 Prices, VAT, automatic renewal, cancellation, the statutory right of withdrawal and refunds are governed by our Refund & Subscription Terms, which form part of these Terms.

8. User content and conduct

8.1 The Service may include features that let you create or share content, such as messages, alliance chat and usernames ("User Content").

8.2 You retain the rights you hold in your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and process your User Content as necessary to provide and operate the Service.

8.3 You are responsible for your User Content and warrant that it does not infringe any third-party rights and does not breach section 5.

8.4 We are not obliged to monitor User Content, but we may remove or disable content that breaches these Terms and take appropriate action against the account concerned.

9. Intellectual property

9.1 The Service and all of its components — including software, source code, graphics, designs, text, game mechanics, trademarks and logos — are owned by the operator or its licensors and are protected by intellectual property rights.

9.2 We grant you a limited, personal, non-transferable, revocable and non-exclusive licence to use the Service for personal, non-commercial purposes, in accordance with these Terms.

9.3 Without our prior written consent, you may not copy, modify, distribute, sell, rent, reverse-engineer or create derivative works from any part of the Service, except to the extent permitted by mandatory law.

10. Availability, "as is" and no warranty

10.1 The Service is provided "as is" and "as available", without any express or implied warranty, to the extent permitted by law.

10.2 We do not warrant that the Service will be uninterrupted, timely, error-free or secure. Maintenance, updates, outages or force majeure may temporarily limit availability.

10.3 As a persistent online game, the Service may be changed, updated or discontinued in whole or in part. We will make reasonable efforts to inform players accordingly.

10.4 Nothing in this section limits your mandatory consumer rights.

11. Limitation of liability

11.1 To the extent permitted by law, our total liability to you on any basis is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the liability, or, if you paid nothing, to a reasonable amount.

11.2 We are not liable for indirect or consequential damage, lost profits, loss of game progress or virtual items, or loss of data, to the extent permitted by law.

11.3 Nothing in these Terms excludes or limits our liability for intent or wilful recklessness, for death or personal injury, or for any other liability that cannot be excluded or limited under mandatory law. Your mandatory consumer rights are unaffected.

12. Suspension and termination

12.1 You may terminate your account at any time via the account settings ("delete account").

12.2 Account lifecycle. On deletion your account is first soft-deleted with a recovery period of 30 days, during which you can reactivate the account by logging in. After that period the account is permanently and irreversibly purged. The processing of your personal data on deletion is described in our Privacy Policy.

12.3 We may suspend (block) your account with immediate effect, remove content or delete your account if you breach these Terms or the game rules, in cases of fraud or abuse, or where the law requires it. For serious or repeated breaches we may permanently purge the account.

12.4 Termination does not affect provisions that by their nature survive, including sections 9, 11 and 14.

13. Changes to the terms

13.1 We may amend these Terms from time to time, for example due to changes in the Service or the law.

13.2 For material changes we will inform you in advance in a reasonable manner, for example via the Service or by email. The "Last updated" date at the top indicates the latest version.

13.3 If you continue to use the Service after the amended Terms take effect, this constitutes your acceptance of them. If you do not agree, you must stop using the Service and may terminate your account.

14. Governing law and disputes

14.1 These Terms are governed by the Netherlands.

14.2 Disputes will be submitted to the competent court in Rotterdam, without prejudice to your mandatory consumer right to bring a dispute before the court of your place of residence.

14.3 The European Commission provides an online dispute resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.

15. Miscellaneous

15.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

15.2 We may transfer our rights and obligations under these Terms to a third party in the context of, for example, a merger, acquisition or reorganisation, with due regard for your rights.

15.3 These Terms, together with the Privacy Policy, the Cookie Policy and the Refund & Subscription Terms, constitute the entire agreement between you and us regarding the Service.
